Midas Fine Art respects the intellectual property rights of others and expects the same of everyone who uses our website. This policy explains how we handle intellectual property and how to report alleged copyright or trademark infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

1. Ownership of Content

Unless otherwise stated, all content on midasfineart.com, including text, product descriptions, photographs, graphics, logos, page layouts, and the Midas Fine Art name, is owned by or licensed to Midas Fine Art and is protected by United States and international copyright and trademark laws. You may not copy, reproduce, modify, distribute, or use any content from this website for commercial purposes without our prior written permission.

2. Permitted Personal Use

You may view and print pages from this website for your own personal, non-commercial use, such as reviewing a product before purchase, provided you do not remove any copyright or other proprietary notices.

3. Purchased Artwork

Purchasing a painting gives you ownership of that physical item only. It does not transfer any copyright, reproduction, or commercial rights in the design. You may not photograph, scan, or reproduce a purchased artwork for resale or commercial use.

4. Reporting Copyright Infringement (DMCA Notice)

If you believe content on our website infringes your copyright, please send a written notice to our designated agent (Section 7) that includes all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work you claim has been infringed
  3. Identification of the material you claim is infringing, including the specific URL(s) where it appears on our website
  4. Your name, mailing address, telephone number, and email address
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf

Notices that do not include all of the above may not be processed. Upon receiving a valid notice, we will promptly review it and remove or disable access to the material where appropriate.

5. Counter-Notification

If material you provided was removed and you believe this was a mistake or misidentification, you may send a counter-notice to our designated agent that includes:

  1. Your physical or electronic signature
  2. Identification of the material removed and the URL where it appeared before removal
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district in which Midas Fine Art may be found), and that you will accept service of process from the person who submitted the original notice

As permitted by 17 U.S.C. § 512(g), we may restore the material 10 to 14 business days after receiving a valid counter-notice unless the original complainant notifies us that it has filed a court action.
